Please read the whole set of Terms and Conditions before using the services of the website: insouq.com.
- Platform: means the website “www.insouq.com”, smart phone applications and related applications of Insouq.
- Service (Services): means any advertisement, subscription package, product, service, content, features, technologies or related services that we, Insouq, provide to you.
Insouq/ Insouq Media LLC is the owner of the website www.insouq.com, smart applications and the insouq brand, with its registered office in Sharjah Media City (Shams), PO Box 6060, Sharjah, United Arab Emirates.
1- Acceptance of the agreement
By using this Platform, you are implying that you agree to all of the terms and conditions of this agreement.
If you do not agree to these terms and conditions, you may not be able to utilize the platform or use the services.
The User hereby acknowledges and agrees that the Platform may contain advertisements placed by individual and corporate advertisers for goods and services and that the Platform bears no responsibility for this.
- The platform offers advertising services rather than products.
- Users under the age of 18 are not permitted to use this platform.
- This Agreement may be modified from time to time as Insouq deems necessary to achieve its objectives, so please review it frequently and adhere to the most recent revisions.
2- Sole proprietorship rights
All trademarks and rights exhibited on this platform, as well as all presented material of photos, audio, graphics, data, and other items, are the exclusive and private property of Insouq and cannot be utilized without the prior written consent of the platform's owner. We provide users permission to explore the platform and repurpose certain content for personal use only. It is not permissible to exploit the platform for commercial reasons or to integrate the platform's website with other websites in any way, and if a person or other website do so, they may face legal consequences.
If you use this platform, you are not allowed to perform the following things:
1-3 Prohibited practices
2.1.3 Do any behavior that disables, affects or damages the platform or disturbs the work or private content or use of the platform to download any software that contains viruses or any computer code, files or programs that may change, damage or impede the work of the platform or any device or software of any person visiting the platform.
3-1-3 Spreading hatred, racism, obscene speech or slander of a person or the platform in violation of the laws that leads to legal accountability.
4-1-3 Remove a copyright notice or any other notice of intellectual property rights from the platform or any content available on or through the platform.
5-1-3 Using the platform to impersonate other persons or entities.
6-1-3 Upload, post, transmit or broadcast prohibited materials or perform any suspicious operations in any way.
7-1-3 Misuse of the platform to gain or attempt to gain unauthorized access to any other systems or websites.
8-1-3 Posting content with inappropriate images.
9-1-3 Using profile pictures of other accounts and store accounts.
10-1-3 Use any phrases that promote illegal activities or violate public morals that are prohibited under the law of the United Arab Emirates.
11-1-3 Defamation or providing false or deceptive information.
2-3 Placing any advertisement, publication, post, message, or comment that contains one of the foregoing prohibitions, as well as engaging in any banned activity as defined by UAE legislation, will result in the violation being removed and reported to the relevant authorities for appropriate legal proceedings.
4- Paid services
1-4 “All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties”.
2-4 The platform accepts electronic payments by MasterCard, Visa, Debit Card and any approved payment card in UAE Dirhams or any currency accepted by MasterCard and Visa.
3-4 The platform provides services that require the subscriber/user to send certain information to an external service provider or an external website that is governed by other policies, terms and conditions, so the user must agree to their terms and policies before using the service, in which case Insouq makes no guarantees or undertakings regarding the safety and security of the information provided to any such third party, or the provision of information. The provision of information is at the user's responsibility and Insouq does not bear any responsibility in connection with the process of transferring to an external link.
4-4 Insouq may charge a fee for various services and advertisements that allow for the publication of a specific advertisement in a specific area of the Platform. The person who posts an advertising, material, or service is responsible for it and for adhering to the terms. If any ad, content, service, or subscription package is withdrawn from the platform for breaking these terms, fees made under this agreement are non-refundable.

4-5 Electronic ads
The platform inserts electronic adverts for external firms in specific areas on its pages for a fee that is non-refundable if they are deleted for breaking the market rules stipulated in the advertising contract agreed with the advertiser.
6.4 The Platform may make changes or operational adjustments to the package of advertising services and individual products that it includes at any time.
7-4 In no case will Insouq's responsibility for supplying a package of advertising services to a client - regardless of the cause of the litigation or the customer's damages - exceed the amount that Insouq received from the customer for that service or advertisement.
Your use of the platform and its content is at your own risk, since the information supplied by the Platform is for informational purposes only and is offered in good faith. However, we make no explicit or implied guarantee or assurance as to the accuracy, sufficiency, correctness, reliability, availability, or completeness of any materials on the platform.
Subject to compliance with the responsibilities established by law and which cannot be excluded, Insouq and each of its directors, employees, agents or contractors shall have no liability to the user as a result of any losses, damages, liabilities, claims or costs (including without limitation legal costs, defense fees or settlement costs) in any way or form, whether directly or indirectly or as a result of or arising out of or in connection with your access to the platform, third-party content, website and application, or third-party services, in any way, whether in contract, harm (including negligence), law, or otherwise.
Any information given or made accessible to the platform by or on behalf of the client may be published on the platform. As a result of the release of this information, the client acknowledges and accepts that the platform is not in violation of any confidentiality requirements.
If you are an owner of intellectual property rights and believe that any material or other content infringes on your intellectual property rights or the intellectual property rights of the owner on whose behalf you are acting, you may send a notice to the company, along with a request to delete the relevant material, in good faith. The notice and request must include the following information:
The signature of a person authorized to act on behalf of the owner of an exclusive right whose rights are allegedly infringed, whether physical or electronic.
1- Determine the intellectual property rights that have been allegedly infringed.
2- Identify materials or content that infringed intellectual property rights through a special link so that it is accessed and removed or access to it is blocked.
3- Provide contact information that allows Insouq to communicate via e-mail or phone number.
4- Provide a signed statement stating that the owner of the intellectual property rights will ward off damage for Insouq against any third party claim in connection with the platform’s removal of the relevant content.
5- Provide a signed statement illustrating that the information in the notification is accurate and subject to penalty of perjury and that you are authorized to act on behalf of the owner of an exclusive right whose rights are allegedly infringed. All such notices must be sent to [email protected]
6- Spam prevention policy
Unsolicited or illegal/ethical or other unsolicited material, spam, and content may result in criminal liability, fines, or imprisonment, and as a user, you understand and agree that sending email advertisements or other unsolicited communications, as well as sending fraudulent email messages through systems Computer to the Platform, is expressly prohibited by these Terms.
Any illegal use of the platform's computer systems is also a violation of these conditions, as well as the laws governing cybercrime (cyber-attack) in the United Arab Emirates.
You acknowledge and agree that the platform may monitor usage from time to time by using human monitors or automated software to flag certain words associated with spam or fraudulent messages sent from one user to another in the Platform's systems and services, and that any such act will subject the perpetrator to prosecution under applicable UAE laws.
7- Limitation of liability
1-7 The company shall not be liable for any of the following:
1-1-7 Direct, indirect or special consequential losses or punitive damages (even if the company has been advised of the possibility of such losses or damages); the platform and its employees, directors and agents shall not be liable for any content posted, stored or uploaded in interactive areas by you or any third party, or for any loss or damage arising therefrom.
2-1-7 Loss of profit, work, income, usufruct, production, opportunities, contracts and savings.
3-1-7 The Platform shall not be liable for any failure in relation to its obligations under this agreement that results directly or indirectly from the failure or interruption of software or services provided by third parties.
4-1-7 Insouq shall not bear the direct or indirect consequences resulting from the user’s usage of a link that transfers it from the website to another website, especially if Insouq has not approved these linked websites or the materials or information available on them.
5-1-7 The accuracy, completeness, or timeliness of the information obtained through the platform are not guaranteed, represented, or warranted by Insouq. The platform takes no responsibility for how the User uses this information. The platform, the service, and all connected facilities are provided "as is" and "as available," with no explicit or implied guarantees from the platform.
6-1-7 The platform may contain advertisement, content or information that is defamatory, contrary to public morals, or in violation of the laws in force in the UAE, therefore, the platform requires you to waive any legal rights in this regard.
7-1-7 Insouq is not responsible or liable for any deletion or failure to store any content maintained or transmitted by the platform.
The platform reserves the right to modify or discontinue the service or part of it at any time with or without notice.
Insouq shall not be liable to you or to any third party for any modification, suspension, or interruption of service, or failure to fully access the services of the platform. You acknowledge and agree that the Platform, in its sole and absolute discretion, may delete or deactivate your account, block your email or IP address, or terminate your access to or use of the platform Services or any part thereof immediately without notice, and/or discontinue any services and online purchases, and remove and discard any content within your account with or without cause. Further, to the extent permitted by law, you agree that Insouq will not be liable to you or any third party for any termination of your access to the platform or the services.
8-1-7 Insouq does not bear any responsibility under this agreement for the failure to access the platform services for any reason mentioned or not.
You acknowledge and understand that Insouq displays advertisements in all categories and according to details provided to it by individual and corporate advertisers, that it does not verify the details of advertisements, data, or information and does not make any guarantees or undertakings to ensure the completeness and accuracy of the details and information, and that you, as a user of the Insouq platform, must exercise due diligence and not rely on the platform for information.
8.1 If you are a customer, user, or one of their officers, directors, employees, agents, contractors, representatives, developers or intermediaries, the following conditions apply to you:
2-8 All categories
1-2-8 The subject of the advertisement is owned by the user advertised through the platform or is legally authorized to manage/deal with it.
2-2-8 The subject of the advertisement is not offered for sale with immediate effect.
3-2-8 Accuracy of information, images, description and inclusion in the appropriate category.
4-2-8 If any of the aforementioned is not owned by you and you are not legally allowed to deal with it, you are not entitled to advertise and include it on the platform, doing so will expose you to legal accountability.
3-8 Real estate
All of what was mentioned in clauses 1-8 and 2-8 shall apply to this, in addition to the following:
1-3-8 You undertake that the project is registered with the Real Estate Regulatory Agency (RERA) in the emirate to which the property belongs.
2-3-8 Brokers and developers: Obtaining the necessary permits if it is sale or lease from the competent authorities for each property separately, for example in Dubai, the RERA permit number, office registration number and broker registration number must be indicated so that they are visible on the platform with details of each ad.
3-3-8 The property owner: You undertake that you are the owner of the property or legally authorized to include the advertisement of the property, whether it is a rental or sale.
4-3-8 Brokers: You warrant that you hold a valid license issued by the Dubai’s Real Estate Regulatory Agency (RERA), or its equivalent in the emirate in which you advertised.
5-3-8 Sub-Leasing: You undertake that you hold a legal license to rent and manage real estate issued by the Department of Economic Development in the emirate in which you are advertising when leasing and that you are authorized to lease it by the property owner.
In addition to clause 4-3-8
6-3-8 Short-term and tourist rental: You undertake that you hold a license for this activity issued by the Department of Economy and Tourism (DET) in Dubai, or the government agencies concerned with organizing this work in the emirate in which the property is located, and that you are authorized to do so by the property owner.
7-3-8 You undertake that the advertisement does not contain any expressions that are contrary to the law and contrary to public morals or the illegal use of the property ownership proof certificate, which includes:
1. Sharing the property ownership in a way that goes beyond the limits of legal occupancy (such as non-compliance with housing for bachelors or using the property by more than one family).
2. Sharing housing between persons of different sexes who are not related to each other.
3. Sharing the property in any way that is considered illegal or in violation of the laws and regulations in force in the United Arab Emirates.
4-8 Required jobs
1-4-8 The platform is not responsible for the material posted in the needed jobs area or in CVs by job seekers. Recruiters may browse resumes in our database using resume search, which is a type of expertise search. Applicants' profiles, on the other hand, may or may not fit the job vacancies. Any fees paid after subscribing to the package will not be reimbursed, and the package's length will not be extended.
2-4-8 Employment professionals will be able to view the CV posted in the job seeker's profile by posting a job search advertisement in the Required Jobs area. Once a job seeker has uploaded their resume to their profile, it will be added to our database and available to recruiters for a period of 12 months.
1-9 The user agrees to defend, indemnify, and hold harmless the platform and all of its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, suppliers, and employees from and against any and all claims, damages, liabilities, and losses, both direct and indirect, arising from the user's improper use of the platform or service.
10- General miscellaneous
1-10 Changes to these Terms
10.2 If any provision of the Terms and Conditions is found to be invalid, void, or unenforceable for any reason, that provision or condition will be struck out, and the legality and enforceability of the other provisions will not be affected.
4-10 The headings in these Terms are for reference only and have no bearing on the extent or effect of any of the agreement's provisions. Our failure to respond to a breach by you or others does not waive our right to respond to similar or subsequent breaches. We cannot promise that we will take action in response to every breach of the Terms.
5-10 The terms, conditions, and policies provided on our services represent the parties' full understanding and agreement, and supersede any prior understandings and agreements.
6-10 Insouq will not be liable for any loss suffered by the other party, or for any delay or failure to comply under this agreement due to acts or events beyond its reasonable control, or force majeure.
7-10 Insouq's failure to implement any of these Terms or to enforce any of its rights under this Agreement shall not be regarded as a waiver of its right to enforce these terms or rights in the future.
8-10 These Terms apply to both parties and are legally binding.
9-10 If these Terms and Conditions are translated into another language and it is demonstrated that the English text and the translated text contradict each other, the Arabic text will prevail.
10-10 All designs, text, visuals, and graphics, as well as their selection and arrangement, are owned by www.insouq.com and all rights are reserved.
10.11 www.insouq.com is a trademark of insouq media l.l.c. or its subsidiaries that is registered in all signatory countries to the Paris Agreement for the Protection of Trademarks and may be registered in other countries. Please contact the support area of our platforms if you require any further information.
11 - Your privacy
Insouq’s platform also has the power to delete any of your material at any time without notice.
